Agreement to Terms

By accessing or using PropStack's property management software and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

PropStack provides property management software available in two forms:

• PropStack Cloud: A hosted software-as-a-service solution with subscription-based pricing
• Free Version: Self-hosted software that you can deploy on your own infrastructure at no cost

User Accounts and Registration

For PropStack Cloud services:

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You may not share your account or allow others to use your account
• One person or legal entity may not maintain more than one free account

Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload or transmit malicious software, viruses, or harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for any fraudulent or illegal activities
• Harass, abuse, or harm others through use of the Service
• Spam or send unsolicited communications through our platform
• Reverse engineer, decompile, or attempt to extract source code from PropStack Cloud

Payment Terms (PropStack Cloud)

For paid subscription plans:

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We may change pricing with 30 days' notice to existing subscribers
• Payment processing fees are handled by our third-party payment processors

Free Version License

The PropStack free version is provided under an open-source license with the following terms:

• You may use, modify, and distribute the software freely
• No warranty or support is provided for the free version
• You are responsible for your own hosting, security, and maintenance
• The software is provided "as-is" without any guarantees

Data Ownership and Privacy

PropStack Cloud:

• You retain ownership of all data you input into the system
• We process your data only as necessary to provide the Service
• You can export your data at any time in standard formats
• We will delete your data within 30 days of account termination

Free Version:

• All data remains on your own servers under your complete control
• We have no access to or responsibility for your self-hosted data

Service Availability

For PropStack Cloud:

• We strive for 99.9% uptime but cannot guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We are not liable for downtime, data loss, or service interruptions
• Service level agreements are available for Enterprise plans

Intellectual Property

PropStack Cloud: We retain all rights to our proprietary software, trademarks, and service marks.

Free Version: Released under an open-source license that grants you extensive usage rights while preserving certain intellectual property protections.

Limitation of Liability

To the fullest extent permitted by law, PropStack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold PropStack harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Termination

We may terminate or suspend your access to the Service:

• Immediately for violation of these Terms
• For non-payment of subscription fees
• If we discontinue the Service with 30 days' notice

You may terminate your account at any time by canceling your subscription or deleting your account.

Governing Law

These Terms are governed by the laws of [Your Jurisdiction]. Any disputes will be resolved in the courts of [Your Jurisdiction]. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Changes to Terms
